Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services provided by Enspire Connections LLC ("Commitment Fund," "we," "our," or "us"). By using our services, you agree to these Terms. Please read them carefully.
1. Eligibility
You must be at least 18 years old to use our services. By registering, you represent and warrant that you are at least 18 and legally able to enter into binding agreements.
2. Services Provided
Commitment Fund provides accountability coaching and tools designed to help entrepreneurs and business owners stay consistent with their commitments. Our services may include:
- Access to an online portal for setting and tracking commitments.
- Weekly 30-minute accountability meetings ("Core" plan).
- Weekly 30-minute accountability meetings plus an additional 45-minute deep-dive session ("Pro" plan).
- Portal-only access without coaching ("Lite" plan).
Clients may also place financial wagers tied to their commitments. If commitments are not met, charges may be applied to the client's payment method as described below.
3. Billing and Payments
- All plans are billed on a recurring 28-day cycle unless a client chooses a 4-cycle prepay (4 months) or 12-cycle prepay (annual) option.
- The Core and Pro plans require a $500 onboarding fee unless the user prepays for 4 months or 12 months.
- Payments are processed through Stripe, and by using our services you also agree to Stripe's terms and conditions.
- Clients authorize Commitment Fund to automatically charge the payment method on file for subscription renewals, onboarding fees, and wagers.
4. Refund Policy
- 30-Day Money Back Guarantee (Core & Pro Prepaid Plans Only): Eligible clients may request a full refund within 30 days of purchase if they:
- Completed at least 5 commitments within the 30-day period, and
- Attended 4 weekly accountability meetings.
- Early Termination of Prepaid Plans: Clients may cancel early, provided they pay the $500 onboarding fee. The unused portion of the prepaid term will then be refunded.
- Other Plans: No refunds are offered for Lite or subscription-based plans outside the guarantee above.
5. Commitment Wagers
By using our services, you agree that:
- You authorize The Commitment Fund to charge your payment method if you fail to meet a commitment or submit acceptable proof.
- Funds collected for missed commitments are distributed in charitable ways at our discretion. Users have no control over or entitlement to direct how these funds are allocated.
6. Cancellations and Termination
- Clients may cancel services immediately at any time.
- We may terminate a client's account, without refund, if they engage in abusive, fraudulent, or non-compliant behavior.
7. User Responsibilities
Clients agree to:
- Submit accurate proof of completed commitments (e.g., photo/video).
- Not attempt to manipulate, falsify, or cheat the system.
- Accept that Commitment Fund reserves the right to verify or reject proof at its discretion.
8. Coaching Scope and Disclaimers
- Coaching sessions are for accountability and business support purposes only.
- Our coaches do not provide legal, financial, medical, or psychological advice.
- No guarantees are made regarding specific business outcomes, revenue growth, or productivity increases.
9. Intellectual Property
All content, software, branding, training materials, and other resources made available through Commitment Fund remain the exclusive property of Enspire Connections LLC. Clients may not copy, modify, resell, or use such materials outside the scope of the services provided.
10. Privacy and Data Use
We collect and store personal information including user account data, proof submissions, and payment details. By using our services, you consent to our collection and use of this information to provide services, process payments, and enforce accountability measures. We take reasonable measures to safeguard data, but no system is 100% secure.
11. Text and Email Reminders
As part of the Commitment Fund services, you may choose to receive reminders and updates regarding your commitments via email, SMS text message, or other communication channels. By opting in, you consent to receive such notifications from us.
Consent to receive reminders is optional and may be withdrawn at any time through your account settings or by following the opt-out instructions included in each message.
Standard text messaging and data rates may apply depending on your mobile carrier.
Notifications are provided as a convenience only. You remain solely responsible for tracking and completing your commitments regardless of whether you receive or view a reminder.
12. Limitation of Liability
To the maximum extent permitted by law:
- Our total liability to any client is limited to the amount the client has paid to The Commitment Fund in the four (4) months preceding the claim.
- We are not responsible for indirect, incidental, or consequential damages.
13. Indemnification
Clients agree to indemnify and hold harmless Enspire Connections LLC, its officers, employees, and contractors from any claims, disputes, chargebacks, or damages arising from misuse of the service or violation of these Terms.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles.
Any dispute or claim arising out of or relating to these Terms shall be resolved by binding arbitration in North Carolina, in accordance with the rules of the American Arbitration Association. Clients waive the right to pursue claims in court or by jury trial, except where prohibited by law.
15. Modifications to Terms
We may update or modify these Terms from time to time. Continued use of the services after changes take effect constitutes acceptance of the updated Terms.
